For over 13 years, counsel for major corporations has sought the economic expertise of Dr. Snail, a Vice President in the Competition Practice of Charles River Associates (CRA), in complex commercial litigation matters. Dr. Snail has assisted clients in developing successful economic testimony for a variety of high-stakes antitrust and competition matters (including those involving mergers, monopolization, price fixing, exclusionary conduct, and antitrust counterclaims arising from intellectual property disputes), as well as other commercial litigation matters (including those involving breach of contract, fraud, false claims, kickbacks, and patent and copyright infringement). Dr. Snail has been engaged in litigation matters involving class certification, economic analysis of liability, estimation of monetary damages, motions to dismiss, summary judgment motions, Daubert motions, deposition and trial testimony, and settlement negotiations.
Dr. Snail has extensive experience in healthcare markets and regulation involving health plans, pharmaceutical benefit managers (PBMs), physician practices, hospitals, nursing homes, pharmacies, branded and generic pharmaceuticals and biologicals, wholesalers, and distributors. His industry expertise also includes chemicals, agricultural products, telecommunications, computer software, music, consumer products, and insurance. He also has extensive experience with the operation of government healthcare programs, such as Medicare and Medicaid, as well as their reimbursement policies.
Prior to joining CRA, Dr. Snail taught antitrust economics at Boston College and graduate courses in microeconomics and finance at the University of California, Berkeley, and conducted economic research for Abt Associates. He has served as a referee for peer-reviewed economic publications, and recently published a chapter on overcharges in the American Bar Association monograph Proving Antitrust Damages.
